The basis, Functional flowchart

A functional flowchart is a diagram of a web site as a whole that shows page elements, relationships between pages, as well as processes and rules associated with the functions of the site. The functional flowchart shows the cognitive architecture of the site in great detail and is the basis for functional templates. Together, the functional flows and templates provide the glue that gives specifications to Visual Design, Content Design, Production Design, and technical teams to use as a basis for their design deliverables.

Patent, Hutchinson Patent Stopper

Charles G. Hutchinson invented and patented the Hutchinson Patent Stopper in 1879 as a replacement for cork bottle stoppers which were commonly being used as stoppers on soda water or pop bottles. His invention employed a wire spring attached to a rubber seal. Production of these stoppers was discontinued in 1912.

Peter Messerli is the current Vice-President of the European Patent Office (EPO) and head of the Boards of Appeal of the EPO known as DG3 (Directorate-General, 3, Appeals) since 1996.

He was head of the Patent Division at the Swiss Federal Institute for Intellectual Property before joining the EPO.

Patent, Small entity status

Small entity status in United States patent law allows small businesses, independent inventors, nonprofit organizations to file a patent application and maintain an issued patent for a reduced fee—a 50% reduction.

Under 13 CFR 121.802(a), an entity qualifies as a “small business concern,” and so qualifies for small entity status, if its number of employees, including affiliates, does not exceed 500 persons.

If an organization or individual qualifies for small entity status, claiming such status is relatively simple. The person seeking such status needs to simply file a verified statement in the patent application prior to paying the first fee as a small entity. Any subsequent payments only need to include a statement where such status has changed.

Loss of status

Small entity status is lost when the patent is licensed, exclusively or non-exclusively, or assigned to an organization that would not itself qualify for small entity status. Special care should be taken by an organization licensing technology to the government. Except for licenses under the Bayh-Dole Act, the government is not a small entity for these purposes and small entity status would be lost.


Improperly claiming small entity status

An organization that improperly claims small entity status may lose patent rights for inequitable conduct.

A hog oiler was a mechanical device employed on farms to be used by hogs to provide relief from insects and offer skin protection. It consisted of a reservoir to hold oil, and a means to distribute the oil onto the hog, often via grooved wheels or cylinders. Hogs seeking relief would rub up against a wheel (or cylinder) causing it to rotate and dispense oil onto their bodies.

Hog oilers were produced in a variety of designs, most made of cast iron. The era of innovation for this device was mainly the years 1913-1923; during this time some 20 patents were issued by the U.S. Patent Office.

Hog oilers are now considered desirable antiques by collectors of agricultural equipment.

A single page application (SPA) is a web application that runs entirely in the client web browser, typically using a combination of HTML, JavaScript, and CSS. The application modifies the web page’s own data structures through its DOM tree, and makes its changes persistent when the user invokes the browser’s Save Page command to save the (modified) web page to disk.

Like DHTML, LAMP, or Ajax, SPA is not a technology in itself, but a term that refers to the use of a group of technologies together.

The EPC 2000 or European Patent Convention 2000 is the version of the European Patent Convention as revised by the Act Revising the Convention on the Grant of European Patents signed in Munich on November 29, 2000. On June 28, 2001, the Administrative Council of the European Patent Office adopted the final new text of the EPC 2000.

The EPC 2000 does not introduce any major changes in substantive patent law. <ref name=epidosnews> European Patent Office, EPC 2000 and its impact for patent searchers, Patent Information News, Issue 1, 2007, page 1. </ref> It introduces however “a considerable number of smaller amendments”. <ref name=epidosnews/>

Background

A diplomatic conference was held from from 20 to 29 November 2000 in Munich to revise the Convention on the Grant of European Patents of 5 October 1973, amongst other things to integrate in the EPC new developments in international law, especially those of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs Agreement) and of the Patent Law Treaty, and to add a level of judicial review of the Boards of Appeal decisions.


Entry into force

Greece deposited its instrument of ratification on December 13, 2005, and was the fifteenth Contracting State to ratify or accede to the revised Convention, known as the EPC 2000.<ref>EPO web site, “Legislative Initiatives in European patent law” microsite, EPC 2000, Status of accession and ratification</ref> The EPC 2000 will thus enter into force on December 13, 2007 at the latest.<ref> Official Journal of the EPO, 2/2006, Notice from the European Patent Office dated 27 January 2006 concerning deposit of the fifteenth instrument of ratification of the EPC Revision Act </ref>

The EPC 2000 could enter into force earlier, that is “on the first day of the third month following the deposit of the instrument of ratification or accession by the Contracting State taking this step as the last of all Contracting States, if this takes place earlier”. A Contracting State that will not have ratified or acceded to the EPC 2000 at the time of its entry into force will cease to be party to the EPC as from that time.<ref> </ref>

The International Patent Institute (or IIB standing for Institut International des Brevets, its French name) was an intellectual property organisation established on June 6, 1947 in The Hague, Netherlands, by a set of European countries, France, Belgium, Luxembourg and the Netherlands. It was integrated into the European Patent Organisation on January 1 1978. Its purpose was to centralize patent searching and archiving as well as the resources needed for the prior art searches for its member countries.
